Welcome to MilkJatt ("we," "our," or "us"). By accessing or using our website at milkjatt.com, our mobile application MilkJatt, or any services provided through them (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use after changes constitutes acceptance.
2. Service Description
MilkJatt is a doorstep dairy delivery service that provides:
- Fresh milk and dairy products delivery
- Subscription-based regular delivery services
- One-time orders for dairy products
- Real-time order tracking and delivery updates
3. User Accounts
A. Registration
To use our Service, you must:
- Be at least 18 years old or have parental consent
- Provide accurate, complete registration information
- Maintain the security of your password
- Notify us immediately of any unauthorized use
B. Account Responsibility
You are responsible for all activities under your account. We reserve the right to suspend or terminate accounts that provide false information or violate these terms.
4. Orders and Payments
A. Order Placement
By placing an order, you make a binding offer to purchase products. Order confirmation is subject to:
- Product availability
- Service area verification
- Payment verification
B. Subscription Services
Our "Subscribe & Save" service requires:
- Minimum subscription period as specified during signup
- Automatic recurring payments until cancellation
- Advance notice for subscription changes or pauses
C. Payment Terms
- All prices are in Indian Rupees (₹)
- Payments are processed through secure third-party gateways
- We accept UPI, credit/debit cards, and net banking
- Cash on Delivery may be available in selected areas
D. Refunds and Cancellations
- Orders can be cancelled before processing for delivery
- Refunds for cancelled orders processed within 5-7 business days
- Quality issues must be reported within 2 hours of delivery for refund consideration
5. Delivery Policy
A. Service Areas
We currently serve selected areas in Lucknow and surrounding regions. Service availability is verified during order placement.
B. Delivery Times
- Morning delivery slots: 6:00 AM - 10:00 AM
- Evening delivery slots: 4:00 PM - 8:00 PM
- Cut-off time for next-day delivery: 9:00 PM
C. Delivery Issues
In case of delivery problems:
- Contact us within 2 hours of scheduled delivery time
- Provide order details and specific issue description
- We will attempt redelivery or provide refund as appropriate
D. Unattended Delivery
If you are unavailable to receive delivery, our delivery executive will attempt to contact you. After two unsuccessful attempts, the order may be cancelled with applicable charges.
6. Product Quality and Returns
A. Quality Assurance
We ensure all products are:
- Fresh and within expiry date
- Properly stored and handled during transit
- From reputable brands and suppliers
B. Returns Policy
We accept returns for:
- Damaged or tampered packaging
- Products received after expiry date
- Incorrect items delivered
- Quality issues reported within 2 hours of delivery
C. Non-returnable Items
For hygiene reasons, we cannot accept returns for:
- Opened dairy products
- Products stored improperly after delivery
- Products with subjective taste preferences
7. User Conduct and Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose
- Create multiple accounts to abuse promotions
- Attempt to gain unauthorized access to our systems
- Harass our delivery personnel or customer service staff
- Provide false or misleading information
- Resell products purchased through our Service
- Use automated systems to access our Service
8. Intellectual Property
All content on our Service, including logos, text, graphics, and software, is our property or licensed to us and protected by intellectual property laws. You may not use our content without express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, MilkJatt shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss or spoilage of products due to improper storage after delivery
- Delivery delays due to traffic, weather, or other unforeseen circumstances
- Minor variations in product quality that don't affect safety
- Third-party actions beyond our reasonable control
Our total liability shall not exceed the amount paid by you for the specific order in question.
10. Termination
We may suspend or terminate your access to the Service:
- For violation of these Terms of Service
- For fraudulent or illegal activities
- For non-payment of amounts due
- For abusive behavior towards our staff
You may terminate your account at any time through the app settings or by contacting us.
11. Governing Law and Dispute Resolution
A. Governing Law
These terms shall be governed by the laws of India, without regard to conflict of law principles.
B. Dispute Resolution
In case of disputes, we encourage you to contact us first at contact@milkjatt.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh.
12. Service Modifications
We reserve the right to:
- Modify or discontinue any Service feature
- Change pricing with 30 days notice to existing subscribers
- Update these terms with notice via email or in-app notification
- Limit quantities available for purchase
13. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
